General terms and conditions
The following general terms and conditions (AGBs) apply to all
Orders application that are given to me. They are deemed to have been agreed if
they are not contradicted immediately.
The important things first
A valid animal liability insurance is a prerequisite for a photo shoot with animal portraits Ute Huber.
Your animal must not be aggressive towards other people or animals. Exceptions (e.g. in the case of animal shelters or trained guard dogs) are possible, but require a clear prior agreement.
Regardless of such an arrangement, I reserve the right to cancel a shoot at any time if I believe that a photo model could pose a threat to other animals or people. There is no entitlement to more pictures than were created at the time of cancellation or to (partial) reimbursement of vouchers used.
I do not guarantee that all motifs requested by the customer or discussed in advance can be completed in the 1 - 2 hours that a photo shoot takes. Each animal has an individual character, handles commands differently and is distracted or disinterested at different rates.
Rules for shooting
You know your pet best, but photo shoots are a new challenge. For outdoor shoots we come e.g. B. is very likely to be in contact with other people or animals. It is therefore your job to keep your pet under control at all times and to avoid dangerous situations. Just like walking for a walk. A photo shoot with a tow line is possible without any problems.
A shoot with several animals is of course possible, but in this case there is a little less time for each photo model than for individual shoots. The total duration of 1 - 2 hours does not increase, because over time both you and the stars in front of the camera get increasingly tired, which also affects the quality of the photos.
Of course, you can also take family members or friends with you. Keep in mind, however, that this could distract your pet unnecessarily and make motifs difficult or impossible. Film or photo recordings by third parties during the shoot require my express permission.
Dates, cancellations, wind and weather
Appointments that you make with me by phone or in writing are considered binding. They can be canceled or postponed free of charge up to 24 hours before the appointment. Except in the case of force majeure, the full price for the photo shoot must be paid less than 24 hours before the appointment or in the event of no-show. If the shoot should have been paid for with a voucher, it is also canceled by this.
Outdoor shootings will of course be postponed free of charge in bad weather, even on the same day. That's why I always arrange an alternative date with you to be on the safe side.
Coupons
The cost of a voucher must be transferred in advance.
The voucher is valid for 3 years from the date of purchase. After the deadline, it is no longer possible to extend the voucher.
Photos and image rights
The conditions relate to private photo shoots with photos for the customer's own use. The commercial use (e.g. for breeders, advertising or stock photography) is not part of the performance of animal portraits Ute Huber but is subject to separate agreements that are to be negotiated with the photographer Ute Huber on a job-specific basis.
The copyright of all images remains with the photographer Ute Huber.
Unless you object, please allow me to use the images for my own advertising (e.g. online portfolio, animal portraits, Ute Huber page on Facebook, flyer, exhibition stand).
However, I do not automatically acquire the exploitation rights for the full commercial use of the images created (use in picture agencies, etc.). This is only done through a separate written agreement that you may or may not sign.
The agreed conditions for the services included in the price as well as the currently valid price list for reorders can be found in the online gallery, which you will get activated for two weeks after the shoot and a certain processing time.
If you do not select any photos within 14 days of making the online gallery available and there are no other agreements in writing, I reserve the right to charge a processing fee for uploading and making the online gallery available again.
The use of the images or files in photo competitions is not permitted.
Photos you have ordered will be processed by me on the computer in terms of detail, color and sharpness. Small retouching such as skin blemishes or crumbs in the fur are also included.
More complex retouching is possible, but will be billed separately according to the effort and will of course be discussed with you beforehand.
Files
A publication of unedited, high-resolution photo files is excluded. Edited, high-resolution jpg files for private use can, however, be purchased or are included in the price of some offers.
An edited, high-resolution file is a JPG format file. The exact number of pixels varies depending on the image section, but it is always data for images at least 20x30 cm at 200 dpi. This corresponds to the order of magnitude for exposures, which can also be ordered from Ute Huber's animal portraits.
Invoices, retention of title and complaints
For private individuals, final prices including statutory VAT are shown.
The fee for a shoot is due in cash on site.
Invoices that are due must be paid within 14 days without any deductions. The client is in default if he does not meet the request for payment within 30 days.
Delivered works (exposures, canvases, photo books, etc.) remain the property of the photographer until the purchase price has been paid in full.
Until a voucher has been paid for in full, it cannot be redeemed.
Complaints must be communicated to me in writing within 5 days of the delivery date. Otherwise, the delivered works are deemed to have been accepted and further claims are excluded.
Understandably, I cannot guarantee the quality of printouts that you (have) made elsewhere with the image files you have purchased from me. Unfortunately, digital files cannot be exchanged.
If I have not been given any express instructions regarding the design of the works (e.g. the image composition or the arrangement of a photo book), complaints relating to the artistic and technical design are excluded.
